Make the Right Custody Decision

The courts allow for some flexibility when it comes to how you and your spouse structure your lives and the lives of your children. Decisions will need to be made on the following things:
  • Legal custody — This means one parent can make decisions for education, religion, and medical issues. This can be appointed to the parent with primary physical custody but joint legal custody is also an option.
  • Physical custody — This has to do specifically with where your child will be permanently residing. Having joint physical custody means that your children spend time in each of your homes and both places are considered residences. Another common option is where one parent has sole physical custody and the other parent has visitation rights.
You and your spouse should make these decisions based on your schedules, your children's schedules, and your goals regarding time spent with your children.
